ARTICLE 1 - Scope

These General Terms and Conditions of Sale (hereinafter "GTCS") apply without restriction or reservation to all sales concluded by the Seller with non-professional buyers ("Customers" or "the Customer") wishing to acquire the products offered for sale ("the Products") by the Seller on the website www.sumni.fr.

The Products offered for sale on the site are as follows:

  • Ready-to-wear articles, second-hand and vintage clothing and fashion accessories, including shoes and leather goods.

The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity, are presented on the site sumni.fr, which the Customer is required to review before placing an order. The choice and purchase of a Product are solely the responsibility of the Customer. The offers of Products are subject to availability as specified at the time of order placement. These GTCS are accessible at any time on the site sumni.fr and will prevail over any other document.

The Customer declares that they have read these GTCS and accepted them by checking the box provided for this purpose before commencing the online ordering process. Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

The Products presented on the site sumni.fr are offered for sale in the following territories: Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Sweden, Czech Republic.

 


 

ARTICLE 2 - Prices

The Products are provided at the current prices listed on the site sumni.fr at the time of order registration by the Seller. Prices are expressed in Euros including VAT. The rates take into account any discounts granted by the Seller on the site sumni.fr. These rates are firm and not subject to revision during their validity period, but the Seller reserves the right to modify prices at any time outside of the validity period. Prices do not include processing, shipping, transport, and delivery fees, which are charged additionally, according to the conditions indicated on the site and calculated prior to order placement. The amount requested from the Customer corresponds to the total amount of the purchase, including these fees. An invoice is issued by the Seller and given to the Customer upon delivery of the ordered Products.

 


 

ARTICLE 3 - Orders

It is the Customer's responsibility to select the Products they wish to order on the site sumni.fr, according to the following procedures:

  • The Customer selects the Products of their choice on the site and adds them to their virtual cart. They can modify their cart (quantities, removal of items) before validating their order.
  • The Customer can place an order as a "guest" or by creating a customer account. After validating their cart, the Customer enters their delivery information and chooses their mode of transport. A complete summary of the order is displayed, including the total price including VAT and shipping fees.
  • The Customer must then accept these GTCS by checking the box provided for this purpose and proceed with secure payment. The sale is considered final after payment validation. An order confirmation is then sent by email to the Customer, serving as proof of purchase.

Product offers are valid as long as they are visible on the site, subject to availability. The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors. Any order placed on the site sumni.fr constitutes the formation of a distance contract between the Customer and the Seller. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order. The Customer can track the status of their order on the site. Order cancellation is possible without charge as long as the package has not been handed over to the carrier. Once the order has been shipped, cancellation is no longer possible and the Customer must exercise their right of withdrawal after receipt of the package, bearing the return shipping costs.

 


 

ARTICLE 4 - Payment Conditions

The price is payable in full at the time of order placement via secure payment (credit card). Data is exchanged in encrypted mode (SSL protocol). Payments are only considered definitive after effective receipt of the funds by the Seller.

 


 

ARTICLE 5 - Deliveries

Deliveries occur within a timeframe that includes preparation (2 to 3 working days) and shipping:

  • Metropolitan France: 4 to 6 working days in total.
  • European Union: 5 to 10 working days in total.

If the Products have not been delivered within 30 working days after the indicative delivery date (excluding cases of force majeure or actions by the Customer), the sale may be resolved at the written request of the Customer (articles L 216-2 and following of the Consumer Code). Deliveries are carried out by an independent carrier, to the address specified by the Customer at the time of order and to which the carrier can easily access. When the Customer has chosen to use a carrier they have arranged themselves, delivery is deemed to have been completed as soon as the ordered Products have been handed over by the Seller to the carrier who accepted them without reservation.

The Customer acknowledges that it is the carrier's responsibility to make the delivery and has no recourse against the Seller in the event of a failure to deliver the transported goods. In case of a specific request from the Customer regarding the packaging or transport conditions of the ordered products, duly accepted in writing by the Seller, the associated costs will be subject to a specific additional charge, based on a quote previously accepted in writing by the Customer.

The Customer is required to check the condition of the delivered products. They have a period of 3 days from the date of delivery to submit complaints by email to contact@sumni.fr. To be valid, the complaint must specify the order number and be accompanied by clear photographs showing the defect or compliance issue claimed, along with all relevant supporting documents (photos, etc.). After this period and without having fulfilled these formalities, the Products will be deemed compliant and free from any apparent defect, and no complaint will be validly accepted by the Seller.

The Seller will refund or replace as soon as possible and at their expense, the delivered Products whose defects of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions provided for in articles L 217-4 and following of the Consumer Code and those set forth in these GTCS. The transfer of risks of loss and deterioration will only occur when the Customer physically takes possession of the Products. Therefore, the Products travel at the risk and peril of the Seller unless the Customer has chosen the carrier themselves. In this case, the risks are transferred at the time of handover of the goods to the carrier.

 


 

ARTICLE 6 - Transfer of Ownership

Ownership of the Products from the Seller to the Customer will only be transferred after full payment of the price by the latter, regardless of the delivery date of said Products.

 


 

ARTICLE 7 - Right of Withdrawal

According to the provisions of article L221-18 of the Consumer Code, "For contracts providing for the regular delivery of goods over a defined period, the period runs from the receipt of the first good."

The right of withdrawal can be exercised online, using the attached withdrawal form and also available on the site or through any unambiguous declaration expressing the will to withdraw, including by postal mail addressed to the Seller at the contact details provided in ARTICLE 1 of the GTCS. Returns must be made in their original and complete condition (packaging, accessories, manual...) allowing for their resale as new, accompanied by the purchase invoice. Damaged, soiled, or incomplete Products will not be accepted for return. Return shipping costs remain the responsibility of the Customer.

Exchange (subject to availability) or refund will be performed within 14 days from the receipt by the Seller of the Products returned by the Customer in accordance with the provisions of this article.

 


 

ARTICLE 8 - Seller's Responsibility - Guarantees

The Products benefit from the legal guarantee of conformity (art. L217-4 and following of the Consumer Code) and the guarantee against hidden defects (art. 1641 of the Civil Code). The Seller's liability cannot be engaged in case of improper use, professional use, negligence, or lack of maintenance by the Customer (inappropriate washing of vintage garments in particular). Photographs on the site are not contractual.

 


 

ARTICLE 9 - Personal Data

The personal data collected on the site sumni.fr includes:

  • Required data for product orders (necessary for delivery).
  • Date of birth (optional).

This data is retained for 5 years. The Customer has the right to access, rectify, delete, and transfer their data. To exercise these rights, the Customer can send an email to: contact@sumni.fr. In case of a dispute, the Customer may file a complaint with the CNIL (French Data Protection Authority).

 


 

ARTICLE 10 - Intellectual Property

The content of the site sumni.fr is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement.

 


 

ARTICLE 11 - Applicable Law - Language

These GTCS and the operations resulting therefrom are governed and subject to French law. These GTCS are written in the French language. In the event that they are translated into one or more foreign languages, only the French text shall prevail in case of dispute.
